Privacy Policy & Marketplace Terms

Last updated: [DATE]. This document covers both how we handle your data and the terms that apply to using Onward as a marketplace.

Draft notice: this page is a starting-point template, not a substitute for review by a qualified lawyer in your jurisdiction. Placeholders like [DATE], [COMPANY NAME], [JURISDICTION], and [CONTACT EMAIL] need to be filled in, and the whole document should be reviewed before this app handles real transactions.

1. What Onward Is

Onward is a listing and communication platform that helps sellers publish yard sales (“yards”) and the individual items in them (“treasures”), and helps buyers discover, reserve, and arrange to buy those items directly from sellers.

Onward is not a party to any sale. We don't own, inspect, certify, or take possession of anything listed. We don't process payments — buyers and sellers arrange and complete payment and pickup entirely between themselves, using whatever payment methods the seller lists. Our role begins and ends at connecting the two of you.

2. No Warranty, Marketplace Risk, and Limitation of Liability

Items listed on Onward are sold by individual sellers, “as-is” and as described by that seller. We do not verify item condition, authenticity, safety, legality, or the accuracy of any listing, and we make no warranty of any kind — express or implied — about any treasure, yard, seller, or buyer.

You are solely responsible for evaluating a listing, communicating with the other party, agreeing on payment and pickup terms, and exercising your own judgment — including in-person safety — when meeting to complete a transaction. To the fullest extent permitted by law, Onward and its operators disclaim all liability for: the condition, legality, or description accuracy of any item; non-payment or non-delivery; disputes between buyers and sellers; and any loss, injury, or damage arising from a transaction or an in-person meeting arranged through the platform.

To the fullest extent permitted by law, our total liability arising out of or relating to your use of Onward is limited to the greater of (a) the amount you paid us directly in the past twelve months (which, since we do not process transaction payments, will typically be zero), or (b) [LIABILITY CAP AMOUNT]. We are not liable for indirect, incidental, consequential, special, or punitive damages.

3. Your Responsibilities

  • List and describe items honestly; don't list stolen, counterfeit, unsafe, or illegal items.
  • Treat other users respectfully — no harassment, threats, or abusive behavior.
  • Keep your account credentials (your email, and access to it) secure — our sign-in is passwordless, so anyone with access to your email can access your account.
  • Use good judgment and reasonable precautions when meeting another user in person.
  • Be at least 18 years old, or the age of majority in your jurisdiction, to create an account or complete a transaction.

You agree to indemnify and hold harmless Onward and its operators from any claim, loss, or expense (including reasonable legal fees) arising from your use of the platform, your listings, or your transactions with other users.

We may suspend or terminate an account that violates these terms, lists prohibited items, or otherwise misuses the platform.

4. Information We Collect

Account information — email address (required to sign in), display name, full name, and WhatsApp number, once you complete your profile.

Listing content — anything a seller enters to create a yard or treasure: title, description, price, category, condition, address, dates, accepted payment methods, and any photos or videos uploaded.

Order information — what a buyer adds to their cart and purchases, quantities, any note left for the seller, and the payment method selected (we never see or store actual payment card or bank details — those are exchanged directly between buyer and seller).

Usage information — which yards you've entered and when (so we can show you your own yard history), and anonymous/aggregate visit counts sellers can see for their own yards.

Device information — a small anonymous identifier stored in a cookie for visit analytics if you're not logged in, and your shopping cart, stored locally in your browser (not on our servers) until checkout.

5. How We Use Information

  • To operate the marketplace: show listings, process cart/checkout, and manage orders.
  • To let buyers and sellers reach each other directly — for example, a seller's WhatsApp number is shown to a buyer after checkout, and a buyer's contact details are shown to the seller fulfilling their order.
  • To send you transactional email: sign-in links, and yard membership invitations if someone adds you to a yard.
  • To show sellers basic, aggregate visit statistics for their own yards.
  • To maintain the security and integrity of the platform.

We do not sell your personal information to third parties, and we do not use it for third-party advertising.

6. How Information Is Shared

With other users, directly. Buying or selling on Onward inherently involves sharing some information with the other party — for example, a buyer's name and contact details become visible to a seller once an order is placed, and a seller's WhatsApp number and yard address are shared with buyers so a transaction can actually happen. Only share what you're comfortable with beyond what the platform requires.

With service providers who help us run Onward, under their own confidentiality and security obligations:

  • Firebase Authentication (Google) — handles sign-in and identity verification.
  • Supabase — hosts our database (accounts, yards, treasures, orders).
  • Cloudflare R2 — stores uploaded photos and videos.
  • Google Workspace (Gmail API) — delivers transactional emails (sign-in links, invitations).

We may also disclose information if required by law, or to protect the rights, safety, or property of Onward or our users.

7. Cookies and Local Storage

We use a small amount of browser storage: a cookie holding an anonymous visitor ID (used only to count unique visits to a yard for the seller's own statistics), and your local device's storage for your shopping cart before checkout. We don't use third-party advertising or tracking cookies.

8. Data Retention and Your Choices

We retain account and transaction information for as long as your account is active and as needed to meet legal, accounting, or dispute-resolution obligations. You can request access to, correction of, or deletion of your personal information by contacting us at [CONTACT EMAIL]. Deleting your account may not remove information already shared directly with another user (for example, an order a seller already fulfilled).

9. Security

We use reasonable technical and organizational measures to protect your information, but no method of transmission or storage is completely secure, and we can't guarantee absolute security.

10. Children's Privacy

Onward is not directed at, and should not be used by, anyone under 18 — in part because transactions involve arranging in-person meetings. We don't knowingly collect information from children.

11. Changes to This Policy

We may update this page from time to time. Material changes will be reflected by updating the “Last updated” date above; continued use of Onward after a change means you accept the updated terms.

12. Governing Law & Contact

This policy is governed by the laws of [JURISDICTION], without regard to conflict-of-law principles.
